Visitor visas · Parents for an event

A visitor visa for parents to attend a graduation or wedding: the invitation letter, the genuine visitor test for a retired parent, applying early, and the sponsored stream

The graduation is in June, the wedding is in November, and the parents who have never been to Australia need a visa that will be granted in time and will not be refused because the officer thinks they will stay. The visa is the ordinary visitor visa, decided on the ordinary criterion, and the event helps because it gives the visit a purpose and a date; what decides the application is the parents’ ties at home, their funds or their child’s undertaking, and the family’s history with Australian visas. This guide sets out what the invitation letter says, the evidence of the event, how a retired parent without an employer shows they will return, the funds and who pays, the stay period to ask for, applying early enough for the processing times by country, the sponsored family stream with its bond and its review rights, the parent who has been refused before, and the parent who wants to stay on after the wedding, where the honest answers are the visitor visa’s own limits and the sponsored parent visa.

The visa and the streams

Parents of a passport that qualifies for the ETA or the eVisitor apply through those and are granted in minutes if their history is clear; parents of every other passport, and parents whose history the automated visas refuse, apply for the visitor visa, subclass 600, in the tourist stream, where the parents apply on their own evidence, or the sponsored family stream, where an Australian citizen or permanent resident child sponsors them, may lodge a bond, and gains review rights if the application is refused. The event does not change the visa; it is the purpose the application states and the date the stay is planned around. The visitor visa guide covers the criteria, and the ETA refused guide the parent whose automated application was refused.

The genuine visitor criterion

The visitor visa requires the Department to be satisfied that the applicant genuinely intends to stay temporarily for the purpose stated, and the officer reads that intention from the applicant's circumstances: the ties to the home country that will draw them back, the funds for the visit, the purpose and whether it is real and dated, the applicant's immigration history with Australia and elsewhere, the conditions in the home country, and the family's history, including whether other relatives came to visit and stayed. A parent coming for a child's graduation or wedding has a purpose that is easy to prove and a date that fixes the stay, which is why these applications are granted in the ordinary case; the ones refused are those where the parent's ties at home are thin, the child's own status suggests the parent would stay, or the family's history includes an overstay or a previous refusal that was not explained.

The invitation letter

The child in Australia writes a letter, dated and signed, that says who they are, their visa or citizenship status with a copy of the grant or the certificate, their address, who the parents are and the relationship with the birth certificate that shows it, the event with its date and venue and the confirming document attached, the dates of the visit the child is inviting them for, where the parents will stay, and what the child will pay for, with the child's own evidence of means where the child is paying; it says the parents will return home after the visit because that is the plan, without undertakings the child cannot give. A letter that reads as drafted to persuade, that recites the law, or that promises the parents' good behaviour does nothing a plain letter does not, and a letter that overstates the child's means or status is a false statement in the parents' application. The letter is one document among the parents' own; it does not carry the application.

The evidence of the event

  • For a graduation: the university's letter or email confirming the student's completion and the ceremony date, and the graduation registration; most universities issue an invitation letter for family visas on request.
  • For a wedding: the notice of intended marriage lodged with the celebrant, the celebrant's or the venue's booking confirmation with the date, and the invitation; for a wedding abroad that the parents will attend before or after visiting Australia, the same from that country.
  • For a religious ceremony, a baptism, a naming or a cultural event: the organiser's confirmation.
  • The itinerary around the event, which gives the stay its shape and its end.

A retired parent's ties

The genuine visitor criterion asks for ties that will draw the parent home, and a parent with no employer shows them through everything else: pension, superannuation or rental income with the statements that show it continuing; the house or flat they own with the title or the lease with the agreement; the other children and grandchildren who live in the home country with their details; the spouse who is not travelling, or who is travelling and will return with them; the medical care they receive at home, which is also evidence they will not seek it in Australia; the religious, community and social commitments that fill their week; the business or the farm they still have a hand in; and the previous travel abroad from which they returned on time, with the passport stamps. A widowed parent whose only child is in Australia, who has sold the house to be free to travel, and who has no income of their own, is the applicant the officer reads as likely to stay, and the application for that parent says so and answers it: the reasons they will nonetheless return, the life and the people at home, and, where the truth is that they may later want to live in Australia, the honest statement that any such step would be by the proper visa. The Department does not refuse a parent for having a child in Australia; it refuses a parent whose circumstances suggest the visit is the move.

Funds and who pays

The parents show that they, or someone for them, can pay for the visit, by their own bank statements over three to six months with balances that cover the flights and the stay without a sudden deposit before lodgement, by the child's statement that the child will pay with the child's bank statements and payslips, or by both; the Department's concern is that the parent will not need to work or rely on public funds, and a modest balance with the child's undertaking is enough for a parent staying with the child. A large deposit into the parent's account a week before lodgement, from the child or elsewhere, is read as window dressing and asked about. Health insurance for the visit is strongly recommended and, for a parent over seventy-five, the Department commonly requires a health examination and may require insurance as a condition; the medical treatment guide covers the parent who falls ill during the visit.

The stay to ask for

The application asks for a period of stay and the Department grants what it considers appropriate: a parent coming for a graduation asks for three months and is commonly granted a visa valid for twelve months with stays of three months on each entry, which covers the event and a later visit without a new application; a parent coming for a wedding and staying to help afterwards asks for six months with the reason, and the Department grants six where the funds and the ties support it. A parent of an Australian citizen or permanent resident with a clean visitor history is often granted a longer validity, up to three years in the Department's practice for parents, with condition 8558, which limits the parent to twelve months in any eighteen; a longer validity is asked for in the application with the reasons. The grandparents guide covers the parent who comes to help with children for longer.

Applying early enough

The Department's processing times for the visitor visa differ by the applicant's country and by stream, from days for some passports to months for others, and a parent from a country where applications draw biometrics requests, health examinations and character checks, or where the Department's workload is heavy, is in the months; a graduation or wedding date is not a reason the Department accepts for priority. The application is lodged four months before the event as a rule and six for a slow country or a parent with a history, flights are booked on the grant, and the invitation letter says the flights will be booked on the grant so the officer does not read booked flights as presumption. The priority guide explains why an event is not an urgent ground, and the processing times report carries the current figures.

An Australian citizen or permanent resident, or an eligible New Zealand citizen, who is the parent's child can sponsor the parent's visitor visa in the sponsored family stream: the sponsor lodges a sponsorship with the application, undertakes that the parent will comply with the visa, and may be asked for a security bond, which the Department sets in the thousands of dollars and returns when the parent leaves on time and forfeits when they do not; the visa is granted for a single entry of up to twelve months with a no further stay condition in most grants, so the parent cannot apply to stay on, and a refusal is reviewable by the sponsor at the Tribunal, which the tourist stream refusal of a parent abroad is not. The stream is the route for a parent whose own case is weak, who has been refused before, or whose family wants the review right; for a parent with a strong case it adds a bond and a condition for nothing, and the tourist stream is used. A parent on a sponsored family visitor visa cannot apply for the sponsored parent visa or a partner visa while in Australia without a waiver of the condition.

A parent refused before

A parent whose earlier visitor application was refused, in Australia or elsewhere, discloses it, attaches the refusal letter, and addresses the reason: a refusal on the genuine visitor criterion is answered with the ties evidence the earlier application lacked, a refusal on funds with the funds, and a refusal on an undisclosed matter with the disclosure. A second application that repeats the first with a new date is refused again, and the family sometimes learns only then that the earlier refusal's reason was something the parent did not tell them. The sponsored family stream, with its review right, is the sensible stream for a second application. The visitor refusal guide covers the review and the reapplication.

The parent who wants to stay on

A parent who, after the wedding, wants to stay for the grandchild's birth or to live near the family has a visitor visa that permits a visit, and the honest answers are the visitor visa's own: a further visitor visa applied for in Australia where the current one has no further stay condition, for a stay within the limits; the sponsored parent visa, subclass 870, which the child sponsors for three or five years at a cost and which is applied for from outside Australia; or the parent visas with their queues. A parent who overstays, or who applies for a partner or other visa the visitor visa was not meant to lead to, damages every later application the family makes. The want-to-stay guide covers what the visitor visa allows, and the 870 guide the visa for a parent who wants years.

Questions we get asked first

What visa do my parents need for my graduation or wedding?

A visitor visa, subclass 600, in the tourist stream or the sponsored family stream, or an ETA or eVisitor where their passport qualifies; there is no event visa, and the event is the purpose that the application states. The Department decides it on the genuine visitor criterion, which is whether the parent intends to visit and leave, and the graduation or wedding is good evidence of a purpose with a date, which helps; the parent's ties at home, funds, and the family's visa history do the rest.

What should the invitation letter say?

Who you are and your status in Australia, who your parents are, the event, its date and venue with the university's or the celebrant's confirmation attached, how long you are inviting them for, where they will stay, and what you will pay for, with evidence of your means if you are paying; signed, dated, with your contact details. It does not need legal language, an undertaking that they will leave, or a promise about their conduct, and it does not replace the parents' own evidence of their ties and funds, which is what the officer reads for the genuine visitor criterion.

My parents are retired with no employer. How do they show they will return?

Through the life they have at home: the pension or superannuation income with statements, the house they own or rent with the documents, the other children and grandchildren at home, the spouse who is not travelling, the medical care they receive, the community and religious commitments, and the previous travel from which they returned. A retired parent with a home, an income and family in the home country is a strong genuine visitor; a widowed parent whose only child is in Australia, with no property and no income, is the applicant the officer looks at hardest, and the application answers the question directly rather than hoping it is not asked.

How early should they apply?

Four months before the event for a parent from a country where the visitor visa is decided in weeks, and six for a country where it takes months or where biometrics or a health examination will be requested; the Department's processing times for the visitor visa run from days to months by country and stream, and an application lodged a month before a wedding by a parent from a slow country is a refusal by delay. Flights are booked on the grant, and the invitation letter says so.

Should I sponsor them in the sponsored family stream?

Where the parents' own case is weak, where they have been refused before, or where the family wants review rights: in the sponsored family stream an Australian citizen or permanent resident child sponsors, may be asked for a security bond of some thousands of dollars that is forfeited if the parent overstays, and the refusal of a sponsored application is reviewable at the Tribunal, which a tourist stream refusal offshore is not. The stream also carries a no further stay condition in most grants, which means the parent cannot apply to stay on. For parents with a strong case the tourist stream is simpler and gives a longer validity.

What does the consultation cost?

A$330 inc. GST for 30 minutes by video with Keshab Chapagain (MARN 1576536), credited in full if you engage WIDEN. For a parents' visit the session reads the parents' circumstances against the genuine visitor criterion, chooses the stream, and lists the evidence so the application is granted in time for the date.
