Visa conditions · No Further Stay 8534

Condition 8534 on your student visa: what it blocks, the exceptions, the waiver that is rarely granted, and leaving to apply from outside

The course is finishing, a partner, an employer or an invitation is in hand, and the student goes to lodge the next visa and is told that condition 8534 on the student visa prevents it. Many holders learn the condition exists at that moment. It is a no further stay condition imposed at grant, usually where a sponsor required the student to return or the Department assessed the risk of staying, and it means that while the holder is in Australia no substantive visa can be granted except the ones the condition excepts; an application lodged in breach is invalid rather than refused, with no bridging visa and no review. The condition can be waived, on a request made before the visa expires, for compelling and compassionate circumstances beyond the holder’s control that arose after the grant, and a job, a relationship or a wish to keep studying is none of those. The practical route for most holders is to leave before the visa expires and apply from outside Australia, where the condition does not operate. This guide covers why it is imposed, what it blocks, the exceptions, the invalid application, the waiver and its evidence, the timing, applying from outside, and how 8534 differs from 8503.

Which student visas carry 8534, and why

Condition 8534 is a discretionary condition the Department may impose on a student visa at grant, and it imposes it in defined situations: where the student is sponsored or funded by their government, by a scholarship body or by an organisation whose terms require the student to return home, where the Department's assessment at the time of the grant was that the applicant presented a risk of seeking to remain beyond the study, which has been applied to applicants from some countries and in some education sectors at various times, and where a previous visa carried a no further stay condition that the Department continues. It is not imposed on every student visa, it is not a finding of bad faith, and it is not imposed later; a student whose grant letter and VEVO record do not show it does not have it. A student whose visa does show it has accepted a visa on the term that it leads nowhere onshore, which is the term the sponsor or the Department wanted, and the rest of this guide is about what that term means and the two ways around it.

Exactly what it prevents

The condition provides that the holder will not be entitled to be granted a substantive visa, other than those it excepts, while the holder is in Australia; and because the criteria for making a valid application for most visas require that the applicant not be subject to a no further stay condition, or that the condition has been waived, the effect is that an application for a partner visa, a 482, a 494, a skilled visa, a visitor visa, a further student visa outside the exception, or any other substantive visa, cannot validly be made onshore while the condition stands. The holder can remain on the student visa to its expiry, can complete the course, can work within the student conditions, and can apply for the visas the condition excepts; what the holder cannot do is convert the student visa into any other stay from inside Australia, which is the point of the condition. A bridging visa is not a substantive visa and is not affected, but a bridging visa is only granted with a valid application, and there is none.

The exceptions written into the condition

The condition itself lists the visas that may be granted notwithstanding it, and as currently written they are a protection visa, a Temporary Graduate visa, subclass 485, and the Student Guardian visa; a further student visa has been within the exception in some forms of the condition and not in others, and the terms that applied to a particular holder are the terms in force when their visa was granted, so a holder reads the condition's text as it was at their grant rather than a summary. The 485 exception is the one that matters most: a student with 8534 who completes an eligible qualification can apply for the 485 onshore, hold it, and from the 485, which does not carry 8534 unless separately imposed, apply onshore for whatever comes next, which is how most holders of the condition move on without ever requesting a waiver. The 485 guide covers the eligibility and the timing, and a student with 8534 plans the 485 application for the window after the course rather than discovering the condition when a partner visa is refused as invalid.

The application made in breach: invalid, not refused

An application lodged onshore for a visa the condition does not except, without a waiver, is not a valid application, and the Department treats it as never made: no bridging visa is granted with it, so the holder's lawful stay depends entirely on the student visa; there is no refusal, so there is no review at the Tribunal; and the visa application charge is dealt with under the refund rules for invalid applications, which return it in some circumstances and not others. The holder who lodged it, paid the charge, waited and received a letter saying the application was invalid has lost the time, and, if the student visa has expired in the meantime, has lost lawful status without noticing, because they believed the bridging visa that never came was protecting them. The invalid application guide covers what follows. A holder checks VEVO for the condition before lodging anything onshore, and an agent who lodges without checking has lodged an invalid application.

The waiver and the circumstances that meet it

The regulations allow the Department to waive the condition where, since the visa was granted, compelling and compassionate circumstances have developed over which the holder had no control and that resulted in a major change to the holder's circumstances, and where the Department is satisfied that the waiver is justified; the same test applies to 8503 and 8535. The circumstances that have met it are the serious kind: a serious illness or injury to the holder or to a close family member in Australia that requires the holder's presence, the death of a family member, a war, a natural disaster or a political upheaval in the home country that makes return unsafe, a change of Australian law or policy that affects the holder's position, and an education provider that closed or lost its registration leaving the holder mid-course. Each is shown with evidence, medical reports, death certificates, travel advice and news, the provider's notice, with a statement that explains how the circumstance arose after the grant, was outside the holder's control and changed their position, and what visa the holder intends to apply for if the waiver is granted. The 8503 waiver guide sets out the test in the same terms, and the evidence that has persuaded the Department under one condition persuades it under the other.

The circumstances that do not

The waiver is not granted for the circumstances that most holders put forward: a job offer or an employer willing to sponsor, because employment is a choice and not a circumstance beyond control; a relationship with an Australian, including marriage and a pregnancy, because the Department treats the relationship as within the holder's control and the partner visa as available from outside Australia; a wish to study further; an improvement in the holder's prospects; financial reasons; a change of mind about returning home; and a sponsor's release from the obligation to return, which the sponsor may give but which does not itself meet the test. A request on those grounds is refused, the time it took is lost, and the holder who waited for the answer with the visa expiring has the timing problem under the next heading. The honest reading at the consultation is often that the waiver is not realistic and that the route is to leave and apply from outside, which is a better answer given early than a refusal given late.

Form 1447 and the timing against expiry

The request is made on the Department's form for a no further stay waiver, Form 1447, with the statement and the evidence, while the student visa is in effect, and the Department decides it in weeks to months with no service standard the holder can rely on; the request gives no bridging visa, does not extend the student visa and does not permit the holder to remain after it expires. A holder lodges the request as soon as the circumstances exist and as far before the expiry as possible, and watches the expiry date: if it approaches without a decision, the holder takes advice on leaving Australia before it, because a holder who stays past the expiry waiting for a waiver becomes unlawful, loses the ability to lodge most visas onshore under the section 48 bar if they ever get the waiver, and, past 28 days, incurs an exclusion period on re-entry; the unlawful guide sets out what that costs. A waiver granted after the holder has left is not wasted, because the application it would have allowed can be made from outside in any case.

Leaving and applying from outside Australia

Condition 8534 operates on the grant of a visa while the holder is in Australia and has no effect on an application made from outside it, so the holder with a partner, an employer or an invitation leaves before the student visa expires, lodges from their home country or any country in which they can lawfully wait, and waits there for the decision, which for a partner visa is many months, for a 482 is weeks to months, and for a skilled visa is months; the holder has no right to return to Australia in the meantime except on a visa for which they qualify and which is granted, a visitor visa for example, and a visitor visa granted to an applicant with a pending application is granted or refused on its own criteria and may carry 8503. The timing is planned so that the holder departs lawfully, the offshore application is lodged with everything ready, and any onshore step that can be taken first, the 485 where eligible, the gathering of evidence, the employer's nomination, is taken before departure. For most holders of 8534 who did not get a waiver this is the route, and it works; what does not work is the application lodged onshore in hope.

8534, 8503 and 8535

Three conditions carry the words no further stay and the same waiver test. Condition 8503 is imposed on visitor and some other temporary visas and prevents the grant of any substantive visa onshore other than a protection visa; its guide is the companion to this one. Condition 8534 is the student visa form, with the exceptions for the 485 and the student guardian visa. Condition 8535 is imposed on student visas where the student is sponsored by the Australian government or a foreign government under a scholarship, and prevents the grant of any substantive visa onshore other than a protection visa or a further student visa with the sponsor's support; it is stricter than 8534 and the 485 is not among its exceptions. A holder reads which of the three is on their visa, on VEVO, because the exceptions differ, and the conditions guide sets out all three.

The 8534 checklist

  1. Check VEVO and the grant letter now for 8534, 8535 or 8503, and read the exceptions as written at your grant.
  2. Do not lodge any onshore application the condition does not except; it will be invalid and carry no bridging visa.
  3. If the 485 is open to you, plan it as the onshore route; the 485 does not carry 8534.
  4. If your circumstances have changed through something serious and outside your control since the grant, lodge Form 1447 with evidence, early, and watch the expiry.
  5. If they have not, plan to leave before the visa expires and apply from outside Australia, with everything ready before you go.
  6. Never stay past the expiry waiting for a waiver.

Questions we get asked first

What is condition 8534?

A 'no further stay' condition imposed on some student visas at grant. While it is on your visa and you are in Australia, you cannot be granted a substantive visa other than the ones the condition itself excepts, which as the condition is written are a protection visa, a Temporary Graduate 485 visa and the Student Guardian visa; a valid application for anything else cannot be made onshore unless the condition is waived first. It appears on VEVO and on the grant letter as condition 8534, and many holders do not know it is there until they try to apply for something.

Why was it put on my visa?

The Department imposes 8534 where it assessed a risk that the holder would seek to stay beyond the study, which includes students sponsored by their government or a scholarship body that requires return, students from some backgrounds and some sectors at the time of the grant, and students whose circumstances suggested the course was a route to another visa. It is not a comment on you personally and it is not a finding against you; it is a condition of the visa you accepted, and it is read against you only if you breach it.

Can I apply for a partner visa, a 482 or a skilled visa onshore with 8534?

Not while the condition is on the visa and you are in Australia. An application for a partner visa, a 482, a 189 or 190, or any other substantive visa not among the exceptions is not a valid application if 8534 applies to you, which means it is not refused, it is treated as never made: no bridging visa is granted, there is no review, and the charge is dealt with under the refund rules. The routes are a waiver first, then the application, or leaving Australia and applying from outside, where 8534 does not operate.

What are the exceptions?

The condition excepts a protection visa, a Temporary Graduate 485 visa and the Student Guardian visa, as it is currently written, and a further student visa in some circumstances depending on the condition's terms at the time of your grant; check the condition's current text and your own grant letter, because the exceptions have changed over time and advice based on an older version is wrong. A holder who completed a course and is eligible for the 485 can apply for it onshore with 8534 on the student visa; a holder who wants a partner visa cannot.

How do I get it waived?

By a written request to the Department on Form 1447, made while the student visa is still in effect, showing compelling and compassionate circumstances that developed after the visa was granted, over which you had no control, and that justify a waiver: a serious illness or injury to you or a close family member here, a death, a war or natural disaster in your home country, a change of law that affects you, a provider that closed. The waiver is a discretion, it is not granted for a job offer, a new relationship, a wish to keep studying or an improvement in your circumstances, and it does not give you a visa; it lets you lodge a valid application for one, which is then assessed on its own criteria.

My visa expires soon and the waiver request is pending. What happens?

The request does not extend your visa and does not give you a bridging visa, so a holder whose visa expires while the request is undecided becomes unlawful unless they leave or hold another visa. You lodge the request as early as the circumstances allow, well before the expiry, and if the expiry is approaching without a decision you take advice on leaving before it, because an unlawful period and an overstay of more than 28 days carry their own consequences for every later application. A waiver granted after you have left Australia is of no use onshore but the application can then be made from outside anyway.

Can I just leave and apply from outside Australia?

Yes. Condition 8534 prevents the grant of a visa while you are in Australia; it does not affect an application made from outside Australia for a visa that can be applied for offshore, which most can. A holder with a partner visa, an employer nomination or a skilled invitation in hand who cannot get a waiver leaves before the student visa expires, lodges from their home country or elsewhere, and waits there for the decision, without work rights in Australia in the meantime. For many holders this is the realistic route and the consultation plans the timing of departure and lodgement.

What does the consultation cost?

A$330 inc. GST for 30 minutes by video with Keshab Chapagain (MARN 1576536), credited in full against any engagement. In it I read your grant letter and VEVO for the condition and its exceptions, your circumstances against the waiver test, and your visa expiry against the timing, and tell you whether the waiver is realistic or whether applying from outside is the route.
