Condition 8503 No Further Stay: what it blocks and how a waiver request works
Condition 8503 is one line on a grant notice: the holder is not entitled to be granted a substantive visa, other than a protection visa, while they remain in Australia. It closes the onshore door to partner, sponsorship, study and further visitor visas alike. It can be waived, but only for circumstances that arose after the visa was granted, outside your control, and serious enough to count as a major change, and a refusal cannot be taken to the Tribunal. This page covers who carries it, what a waiver request has to show, and the timing trap that catches most people.

Thirty minutes to find out whether a waiver is arguable before you build your plan on it.
In the consultation I read your grant notice and the facts that changed since, tell you honestly whether they meet the waiver test, what evidence would be needed, and what the alternative is if they do not: the offshore route, and the dates for it. You leave with a written summary.
What it costs. $330 inc. GST for 30 minutes by video with Keshab Chapagain (MARN 1576536), credited in full against our professional fee if you engage WIDEN to prepare the request or the next application.
What 8503 does
While condition 8503 is on your visa and you are in Australia, no substantive visa other than a protection visa can be granted to you. An application lodged in breach of it is not a valid application: it does not create a bridging visa, it does not keep you lawful, and the Department returns it. The condition says nothing about leaving. You can depart at any time and apply for whatever you qualify for from outside Australia, and for many people that is the plan the condition is pushing them towards. Conditions 8534 and 8535, which appear on some student visas, work the same way with narrower exceptions.
Who carries it
- Visitor (600) visas in the Sponsored Family stream always; Tourist stream grants at the Department's discretion, usually where it doubts the visit is temporary. The 17 September 2026 package announced 8503 on all new Visitor grants, with no start date yet.
- Sponsored Parent (Temporary) 870 visas always.
- Some 403 and 408 grants, and some other temporary visas where it is imposed on grant.
- Any visa granted after a previous waiver request, where the Department chooses to impose it again.
The only way to know is the grant notice, under conditions. Electronic Travel Authority and eVisitor holders should read theirs too rather than assume.
The waiver test
Under regulation 2.05(4) the condition can be waived where, since the visa was granted, compelling and compassionate circumstances have developed over which the person had no control and that resulted in a major change to the person's circumstances. Each element is tested. The circumstances must post-date the grant; they must not be of your making; and they must have changed your situation in a serious way, not merely given you a reason to want to stay. The events that meet it are serious illness or injury of the applicant, the death or serious illness of a close family member in Australia, a natural disaster, conflict or comparable event in the home country, and situations of that weight. Each is proven with documents: medical reports, death certificates, evidence of the relationship, evidence that the event was unforeseeable at grant.
What does not qualify
- A relationship that began or deepened during the visit. It is the most common request and, on its own, the most common refusal, because it is a change the person took part in rather than one beyond their control.
- A job offer, a business opportunity, or a course of study.
- Circumstances that existed at grant, or that were foreseeable at grant: a relative already ill, a pregnancy already known.
- Travel disruption or cost. Being unable to leave is treated differently from not wanting to.
- A general preference for Australia, however sincere.
A request on these grounds is not harmless. It is on the file for every later application, and a refusal is read as the Department having already decided the point.
The timing trap
A waiver request is not a visa application, so no bridging visa is granted with it. If your visa expires while the request is being considered, you are unlawful from that day, with the consequences set out in unlawful in Australia, what now: a Bridging Visa E to stay lawful, a section 48 bar on most onshore applications, and a possible three-year exclusion. The request has to go in as soon as the circumstances arise, and the visa expiry date has to be planned for on the assumption that the answer may not come first. Where the expiry is close, the honest plan is often to depart before it and lodge the substantive application from outside Australia, keeping the waiver request as the second path rather than the only one.
The request
- Form 1447, Request for waiver of a 'No further stay' condition, with no application charge.
- A statement that sets out what changed, when, why it was outside your control, and why it is a major change, in that order.
- Documents for each fact in the statement. The Department decides on what it is given; it does not investigate on your behalf.
- Evidence that the circumstances were not foreseeable at the time of grant.
- Where a substantive application is to follow, the evidence for it should be ready at the same time, because the window after a waiver can be short.
If it is refused
A decision not to waive 8503 is not reviewable at the Administrative Review Tribunal. Judicial review in the Federal Circuit and Family Court is confined to legal error and does not reconsider the merits. In practice a refusal means the onshore path is closed and the plan becomes the offshore one: departing before the visa ends and applying from outside Australia, where the usual rules apply and no condition stands in the way. For partners that is the 309/100 visa; for sponsored workers, an offshore 482; for students, a Student visa lodged from home, which since 2 October 2026 is where most of them are lodged anyway.

I have 8503. Can I apply for a partner visa in Australia?
Not while the condition stands. 8503 means no substantive visa other than a protection visa can be granted while you remain in Australia, so an onshore partner, 482, student or visitor application is not valid. The choices are a waiver request, or leaving and applying from outside Australia, for example a 309 partner visa.
What counts as compelling and compassionate circumstances?
Circumstances that developed after the visa was granted, that you had no control over, and that produced a major change in your situation. The examples that succeed are serious illness or injury, the death or serious illness of a close family member in Australia, a natural disaster or conflict at home, or a comparable event. A new relationship, a job offer, a course place or a wish to stay longer are the usual reasons for asking and the usual reasons for refusal.
Does the waiver request give me a bridging visa?
No. A waiver request is not a visa application, so no bridging visa comes with it. If your visa expires while the request is pending you become unlawful. Lodge the request as early as possible, and have a plan for the expiry date that does not depend on the answer arriving first.
Can I appeal if the waiver is refused?
A refusal to waive 8503 is not a decision the Administrative Review Tribunal can review. Judicial review on legal grounds is possible in principle and rarely practical. The request itself is the one chance, which is why it is worth preparing properly rather than quickly.
Will every visitor visa carry 8503 soon?
The 17 September 2026 package announced that 8503 will be imposed on all new Visitor visa grants. It has no start date yet. Visitor visas granted before it starts carry the condition only where it was imposed on grant; read the grant notice.
What does the consultation cost?
