Withdrawing a visa application: how, what it costs you, and when it is the right move

Withdrawing is simple to do and easy to get wrong. The application charge does not come back, the bridging visa starts a countdown, and the reason for withdrawing decides whether it was wise: done before a refusal that would have triggered a bar, it protects the next application; done in panic, it throws away a bridging visa and a review right for nothing. This guide covers the mechanics, the fee, the bridging visa, the difference between withdrawn and refused, and the situations where withdrawing is the right call.

How to withdraw

In writing, to the Department, before the decision is made. For most applications that is done inside ImmiAccount against the application itself; otherwise Form 1446, Withdrawal of a visa application, is completed and sent to the office handling the application, and some family visas use the Department's online withdrawal form. The withdrawal must be signed by the applicant, or by each applicant being withdrawn where a family application is being split, and an agent may lodge it with authority. The Department confirms the withdrawal in writing, and that confirmation is the date other things run from.

The fee

The visa application charge pays for the Department to assess the application, and a withdrawal does not undo that. It is not refunded because you changed your mind, because the application would have failed, or because circumstances changed. The exceptions are narrow: the application was not a valid application in the first place, the Department made an error, the applicant died, or, in some employer-sponsored cases, the visa cannot proceed because the nomination was refused or withdrawn. A refund is requested on Form 1424 and decided on the Regulations, not on fairness. Budget on the basis that the charge is gone.

The bridging visa

A Bridging Visa A or C granted with the application does not end on withdrawal; it ends a set number of days after the Department notifies you that the withdrawal has been actioned, commonly 35 days for bridging visas granted from late 2016 and 28 for older grants, and the grant notice states which. That period is the window to lodge something else or leave. Lodging a new valid application inside it brings its own bridging visa; leaving inside it keeps the departure clean. Letting it pass makes you unlawful, which starts the 28-day count that PIC 4014 turns on. A Bridging Visa B already granted for travel ends on the same timetable.

Withdrawn is not refused

The distinction carries the whole subject. Section 48 bars most onshore applications after a refusal or cancellation; a withdrawn application was not refused, so the bar is not triggered by it. PIC 4020 starts a three-year exclusion from a refusal for false or misleading information; an application withdrawn before that refusal creates no exclusion. A refusal appears in every later form as a refusal; a withdrawal is recorded, but it is not a decision against you. What does not change is the file. The Department keeps what was lodged, a later application is read against it, and a bogus document in a withdrawn application can still be the basis of a cancellation of a visa obtained with it or a later finding against you. Withdrawal removes the decision, not the facts.

When withdrawing is right

  • Before a refusal that would bar the next application. A natural justice letter on PIC 4020, or an application that will plainly fail and trigger section 48 for the better application you now have, where you still hold a substantive visa or an exempt class is open.
  • When the right visa has become available. An employer nomination approved while a weaker application is pending, or a partner relationship that now meets the criteria, where the pending application adds nothing.
  • When a family member's circumstances have changed. A separation, a child turning 18, a member no longer migrating, where withdrawing that person keeps the rest of the application sound.
  • To leave cleanly. A person who has decided to go, and who leaves within the bridging visa period, avoids a refusal on the record.

When it is wrong

  • To answer a request for more information you do not want to answer. The request is usually answerable, and withdrawal is read as a concession in the next application.
  • After the decision has been made. There is nothing to withdraw; the remedy is review, within the deadline on the letter.
  • Without a substantive visa and without checking section 48. Withdrawing when a refusal has already occurred on another application does not restore the ability to lodge.
  • Because an agent or employer said so without explaining why. The reason for withdrawing is the thing to have in writing before it is done.

Withdrawing a review

A review application at the Administrative Review Tribunal is withdrawn in writing to the Tribunal, and the Department's decision then stands as made. The refusal or cancellation stays on the file, with any exclusion period and the section 48 bar it carries, and the bridging visa tied to the review ends on the timetable in the grant notice. It is the right step for a person leaving Australia who no longer needs the review, or for whom a different visa has become possible; it is rarely the right step merely because the review looks difficult, since the decision it leaves standing is the thing that was difficult.

Sponsors and family members

An employer can withdraw a sponsorship or nomination application, and a visa application that depends on a nomination usually cannot continue without it; in some of those cases the visa charge is refundable, which is one of the narrow exceptions. A partner sponsor can withdraw their sponsorship, which does not withdraw the applicant's application but usually leads to its refusal unless the family violence or other provisions apply. A secondary applicant can be withdrawn from a family application without withdrawing the primary applicant, and the primary applicant's withdrawal takes the whole application with it. Each of these has consequences for the other people on the file, which is why a withdrawal is checked for who else it touches before it is signed.

Questions we get asked first

Do I get the visa fee back if I withdraw?

Almost never. The visa application charge is for the Department assessing the application, and withdrawal does not entitle you to a refund. Refunds are made in narrow cases, for example where the application was not valid, where the Department made an error, or in some employer-sponsored situations where the nomination fails. A refund is requested on Form 1424 and is not automatic.

What happens to my bridging visa?

A Bridging Visa A or C granted with the application ends a set number of days after you are told the withdrawal has been actioned, commonly 35 days for bridging visas granted since late 2016. Your grant notice states the rule for yours. By that date you need another visa or to have left, unless you lodged a new application that brought its own bridging visa.

Is a withdrawal the same as a refusal?

No, and the difference matters. Section 48 bars most onshore applications after a refusal; a withdrawal is not a refusal, so it does not trigger the bar. A refusal under PIC 4020 for false information starts a three-year exclusion; a withdrawal before that decision avoids the refusal. The facts on the file remain, and a later application still has to deal with them.

Can I withdraw after the Department has started deciding?

Yes, at any time before the decision is made. Once the decision is made and notified, there is nothing to withdraw; the remedy is review, if available. If a natural justice letter is on the table the withdrawal has to reach the Department before the decision, which is why timing is checked, not assumed.

Can I withdraw a Tribunal review?

Yes, in writing to the Tribunal. Withdrawing the review leaves the Department's decision standing, so the refusal or cancellation stays on the file with everything that follows from it. People withdraw reviews to leave Australia cleanly or because a different route has opened; it is not something to do to save a hearing fee.

What does the consultation cost?

A$330 inc. GST for 30 minutes by video with Keshab Chapagain (MARN 1576536), credited in full if you engage WIDEN. Whether to withdraw, and when, is exactly the kind of question the session is for, because the timing decides what the next application faces.
