Terms and Conditions — B2B Document Preparation Services

These are the standing terms for WIDEN's documents-only preparation services — including Subclass 482, 186 and 407 nomination documents, Genuine Position Statements, Annual Market Salary Rate reports, Labour Market Testing reports (compiled from the employer's own advertising — we do not run the advertising or collect the evidence), position descriptions, employment contracts, and related compliance reports — provided to migration agents (on a white-label basis) and to employers. The specific documents, fee and turnaround for your matter are set out in the engagement email and tax invoice, which incorporate these terms.

1. Appointment and Authority

The client — a registered migration agent, firm, or employer — appoints WIDEN (Dynamic Consultancy Pty Ltd t/a WIDEN — Migration Experts, MARN 1576536) to prepare the documents specified in the engagement. Where the client is a migration agent or firm, the client confirms they hold authority from their own clients (the sponsor and, where relevant, the visa applicant) to enter into this agreement and to share the information provided.

2. Scope of Services

WIDEN prepares the documents specified in the engagement based on the information and materials provided by the client. Unless the engagement states otherwise, one round of revisions is included; further changes are charged at $165 per hour. Documents are delivered in editable format. WIDEN is not responsible for nomination or visa refusals, or for any decision of the Department of Home Affairs.

3. Fees and Payment

The fee for each matter is quoted in the engagement and is fair and reasonable in the circumstances — taking into account the time involved, the complexity of the matter, and the skill and experience required — consistent with section 46(1) of the Migration (Migration Agents Code of Conduct) Regulations 2021. A tax invoice is issued on confirmation.

Work does not commence until payment has been received in full and all required information has been provided. WIDEN is not obliged to release any document until fees are paid in full.

4. Limitation of Scope of Work

Engagements are documents-only. WIDEN does not, under these terms, provide migration advice to the client's clients, lodge applications, or communicate with the Department of Home Affairs on the matter — the instructing agent or the employer's representative retains carriage of the matter and the client relationship. WIDEN does not guarantee the success of any nomination or visa application, and is not responsible for delays caused by the client or their clients in providing required information.

5. Confidentiality

All engagements are conducted under professional confidence in accordance with section 35 of the Migration (Migration Agents Code of Conduct) Regulations 2021. WIDEN does not contact or solicit the client's clients, and does not retain identifying client data beyond what is reasonably necessary for the engagement and applicable record-keeping obligations. Each engagement is documented in a written service agreement covering scope, fee, turnaround and confidentiality (section 42).

6. Termination

Either party may terminate the engagement by notice. If preparation has commenced, the client remains liable for the work performed to the date of termination, being not less than 50% of the agreed fee.

7. Limitation of Liability

To the extent permitted by law, WIDEN's total liability for any claim arising out of or in connection with an engagement is limited to the professional fees paid for the specific document or matter giving rise to the claim.

8. Governing Law

This agreement is governed by the laws of New South Wales, Australia, and the parties submit to the jurisdiction of its courts.

9. Client's Warranty

The client confirms they understand the services, limitations and liability set out in these terms, and — where the client is a migration agent or firm — that they have communicated the relevant limitations to their own clients.

Agreement Confirmation

By confirming the engagement (including by paying the tax invoice for the matter), both parties agree to be bound by these terms.
