What's inside
- The Genuine Student criterion explained. The current framework (post-March 2024 reform), what the Department is required to consider.
- Source-of-funds depth. What the Department expects when the funding pathway involves Chinese banking, family wealth transfers, or property — and how to document a credible chain.
- Course-pathway logic. Many Chinese applicants already hold substantial qualifications; how to justify the Australian course against existing credentials without triggering the "course-downgrade" finding.
- Immigration intent. How the Department reads claimed ties to China and what tends to be persuasive in the Chinese context.
- Annotated GS statement framework. Section-by-section guidance.
- Common refusal patterns in applications from China. The findings case officers tend to make and what the published framework provides to address them.
- When to seek individual advice. Prior refusals, family in Australia, complex funding structures.

Frequently asked questions
Does this guide guarantee a positive Genuine Student finding?
No. The Genuine Student criterion is a subjective test the Department applies to each application on the evidence as lodged. Section 15 of the Migration Agents Code of Conduct 2022 prohibits any guarantee of outcome by a registered migration agent. The guide is general information about the published framework as it has been applied to applications from China — not a guarantee of any individual decision.
Why a separate guide for applications from China?
Country-specific Department practice notes and historical refusal patterns are part of the published Genuine Student framework. The guide distils what tends to receive closer scrutiny in applications lodged from China — source-of-funds depth and credibility, course-pathway logic where the applicant already holds substantial qualifications, and the article 5 / immigration-intent question — and how to address those areas in the GS statement.
Is this migration advice for my specific student visa application?
No. The guide is general information. It does not constitute migration advice for any specific person and purchase does not create a migration agent–client relationship. For advice on a specific application — particularly if there is a prior refusal — book an initial consultation.
