Is this a substitute for individual migration advice on my refusal?

No. Visa refusals are highly fact-specific and depend on the reasons given by the case officer, the available evidence, and strict time limits for review. The Guide is general information about the Administrative Review Tribunal (ART) process and how the framework operates. Anyone considering an ART review on their own matter needs individual migration advice, urgently — review time limits are short and missed deadlines are rarely reversible.

Does the Guide explain the change from AAT to ART?

Yes. The Administrative Review Tribunal replaced the Administrative Appeals Tribunal (AAT) in October 2024. The Guide covers the current ART migration jurisdiction, the procedural framework, and how it differs from the old AAT process.

Can I lodge an ART appeal myself using this Guide?

Some applicants do self-represent at the ART, and that is permitted. Whether self-representation is appropriate depends entirely on the specific refusal grounds, the available evidence, and the applicant's English and procedural confidence. The Guide is information about the framework, not advice on whether self-representation is the right call in any specific matter.

Does this Guide guarantee my appeal will succeed?

No. Section 15 of the Migration Agents Code of Conduct 2022 prohibits any guarantee of outcome by a registered migration agent. ART decisions are made by Tribunal members on the merits of the individual file under the relevant migration law.
